CONCERNING: INSURING PEACE AND SAFETY OF TRIBAL MEMBERS WHEREAS, the Governing Body of the Fort McDermitt Tribe is the Tribal Council, as set forth in the Constitution, Article III, Section I; and, WHEREAS, the Fort McDermitt Tribal Council is empowered by the Constitution and By-Laws of the Fort McDermitt Tribe and by its inherent traditional powers to oversee and maintain Law and Order within the reservation; and, WHEREAS, the Tribal Council believes it is necessary for the peace and safety of its tribal members to regulate who may be present within the boundaries of the reservation; NOW THEREFORE BE IT RESOLVED, that any Indian or other person within the Fort McDermitt Indian reservation who is found to be engaging in conduct that is contrary to the peace and order of the community shall be escorted off the reservation by any authorized person. Any person so removed shall not be permitted to come on to the reservation without first obtaining the written consent of the Tribal Chairperson or his/her designator. BE IT FURTHER RESOLVED, that the Tribal Council intends to and will enforce resolution no. 70-FM-16, which imposes a curfew on persons under the age of eighteen. CERTIFICATION It is hereby certified that the foregoing Resolution No.FM98-010-0132 Tribal Council of the Fort McDermitt Paiute-Shoshone Tribe, composed of eight (8) members of whom FIVE (5) constituting a quorum were present at a meeting duly held on the 16th day of OCTOBER 1998, was adopted by an affirmative vote; FOUR (4) FOR, ZERO (O) AGAINST, ZERO (0) ABSTAINING; pursuant to the authority contained in the Constitution and By-laws of the Fort McDermitt Paiute-Shoshone Tribe.
