§2 LEGISLATIVE

§2-1-1 TRIBAL COUNCIL ORDINANCES

(a) Pursuant to the Constitution of the Poarch Band of Creek Indians the legislative body of the Poarch Band of Creek Indians shall be the Tribal Council.

(b) All final decisions of the Tribal Council on matters of general permanent interest to the members of the tribe shall be embodied in ordinances known as Tribal Council Ordinances.

(c) Each Ordinance enacted shall bear the year in which the same is enacted and with consecutive numbers indicate the order which said Ordinance was adopted during the year.

(d) Each Ordinance enacted shall contain a brief statement of purpose which summarizes the contents of the Ordinance proposed for enactment in the title thereof.

(e) Tribal Council Ordinances may be referenced by abbreviation substantially as follows: "TCO (year consecutive number)."

(f) The Secretary of the Tribal Council shall cause all Tribal Council ordinances to be permanently bound and consecutively numbered by year and by number in which enacted within each year.

(g) All ordinances shall be codified annually by subject matter and permanently bound. The Tribal Code shall be known, cited and referenced as "The Tribal Code of the Poarch Band of Creek Indians."

(h) All Ordinances which repeal or amend any other Ordinance previously enacted, by any part thereof, shall cite in the title thereof the Ordinance number, section or sections and code sections the same seeks to repeal or amend.

(i) Each code section shall contain at the end thereof a reference citing the ordinance number creating the same.

(j) Each Ordinance enacted by the Tribal Council shall be approved by the Tribal Chairman and certified by the Secretary within ten (10) days and shall include the vote by which the same was enacted and date thereof.

 

§2-2-1 TRIBAL COUNCIL RESOLUTIONS

(a) All final decisions of the Tribal Council on matters of temporary interest shall be embodied in resolutions known as Tribal Council Resolutions.

(b) Each Resolution enacted shall bear the year in which the same is enacted and with consecutive numbers indicate the order in which said Resolution was adopted during each year.

(c) Each Resolution shall contain a brief statement of purpose which summarizes the contents of the Resolution in the title thereof.

(d) Tribal Council Resolutions may be referenced by abbreviation substantially as follows: "TCR (year-consecutive number)."

(e) The Secretary of the Tribal Council shall cause all Tribal Council Resolutions to be permanently bound and consecutively numbered by year and by number in which enacted within each year.

(f) The Secretary of the Tribal Council shall cause to be published each year an annual and cumulative index of all Tribal Council Resolutions by subject matter.

(g) Tribal Council Resolutions shall have the same force and effect of Tribal Council Ordinances except to the extent that any Resolution is in conflict with any ordinance, in which event the Ordinance shall prevail.

(h) All Resolutions heretofore adopted by the Tribal Council are hereby ratified and affirmed.
