SUMMARY: Pursuant to section 814 of the Native
American Programs Act of 1974 (the Act) as amended by 42
U.S.C. 2991 et seq., ANA herein describes its issuance of final
interpretive rules, general statements of policy and rules of agency
procedure or practice in relation to the Social and Economic Development
Strategies (SEDS), Native Language Preservation and Maintenance
(hereinafter referred to as Native Language), Environmental Regulatory
Enhancement (hereinafter referred to as Environmental), Environmental
Mitigation (hereinafter referred to as Mitigation) programs and
any Special Initiatives. Under the statute, ANA is required to provide
members of the public an opportunity to comment on proposed changes
in interpretive rules, statements of general policy and rules of
agency procedure or practice and to give notice of the final adoption
of such changes at least thirty (30) days before the changes become
effective. The notice also provides additional information about
ANA's plan for administering the programs.

SUMMARY: On November 2, 2005, the Environmental
Protection Agency (EPA) published a notice of prospective determination
of the Indian country status of approximately 160 acres of land
located in the southeast portion of Section 8, Township 16N, Range
16W, in the State of New Mexico (70 FR 66402). That notice requests
public input regarding whether the Section 8 land is part of a dependent
Indian community under 18
U.S.C. 1151(b) and, thus, considered to be "Indian country."
This determination is necessary in order to establish whether EPA
or the New Mexico Environment Department is the appropriate agency
to issue a particular underground injection control permit under
the Safe Drinking Water Act.

SUMMARY: The purpose of the program is to award cooperative agreements
that provide negotiation resources to Tribes interested in participating
in the Tribal Self-Governance Program (TSGP) as authorized by Title
V, Tribal Self-Governance Amendments of 2000 of the Indian Self-Determination
and Education Assistance Act of Public
Law (Pub. L.) 93-638, as amended. The TSGP is designed to promote
self-determination by allowing Tribes to assume more control of
Indian Health Service (IHS) programs and services through compacts
negotiated with the IHS. The Negotiation Cooperative Agreement provides
Tribes with funds to help cover the expenses involved in preparing
for and negotiating with the IHS and assists eligible Indian Tribes
to prepare for Compacts and Funding Agreements (FAs) with an effective
date of October 1, 2006, or January 1, 2007.

SUMMARY: In response to the inherent risks of gaming enterprises and the resulting need for effective internal controls in Tribal gaming operations, the National Indian Gaming Commission (Commission or NIGC) first developed Minimum Internal Control Standards (MICS) for Indian gaming in 1999, which have subsequently been revised. The Commission recognized from the outset that periodic technical adjustments and revisions would be necessary in order to keep the MICS effective in protecting Tribal gaming assets and the interests of Tribal stakeholders and the gaming public. To that end, the following proposed rule revisions contain certain proposed corrections and revisions to the Commission's existing MICS, which are necessary to clarify, improve, and update other existing MICS provisions. The purpose of these proposed MICS revisions is to address apparent shortcomings in the MICS and various changes in Tribal gaming technology and methods.

These rates shall apply to all assessable gross revenues from each gaming operation under the jurisdiction of the Commission. If a tribe has a certificate of self-regulation under 25 CFR part 518, the final fee rate on class II revenues for calendar year 2005 shall be one-half of the annual fee rate, which is 0.0265% (.000265)

Entities that administer PIH programs, which include public housing agencies (PHAs), Indian and tribally designated housing entities (TDHEs), and local and tribal governments, and are located in an area declared by the President to be a federal disaster area as a result of Hurricane Rita, may defer compliance with the regulations and other requirements listed in this notice for an initial period of 12 months or such other period as may be specified in this notice. PIH program administrators that are not located in a disaster area but assisting with Hurricane Rita recovery and relief may request waiver of the regulations and administrative requirements listed in this notice, and HUD review and response is available through an expedited waiver request and response process. SUMMARY: The Indian Health Service (IHS), as part of its continuing effort to reduce paperwork and respondent burden, conducts a pre-clearance consultation program to provide the general public and Federal agencies with an opportunity to comment on proposed and/or continuing collections of information in accordance with the Paperwork Reduction Act of 1995 (PRA95) (44 U.S.C. 3506(c)(2)(A)). This program helps to ensure that requested data can be provided in the desired format, reporting burden (time and financial resources) is minimized, collection instruments are clearly understood, and the impact of collection requirements on respondents can be properly assessed. As required by section 3507(a)(1)(D) of the Act, the proposed information collection has been submitted to the Office of Management and Budget (OMB) for review and approval. The IHS received no comments in response to the 60-day Federal Register notice (70 FR 44663) published on August 3, 2005. SUMMARY: The Department of the Interior (Department), Bureau of Indian Affairs (BIA), is amending its regulations by adding a new part to govern the grazing of livestock on the Navajo Partitioned Land (NPL) of the Navajo-Hopi Former Joint Use Area (FJUA) of the 1882 Executive Order reservation. The purpose of this regulation is to conserve the rangelands of the NPL in order to maximize future use of the land for grazing and other purposes, while recognizing the importance of livestock in the Navajo way of life.

The Commission recognized from the outset that periodic technical adjustments and revisions would be necessary in order to keep the MICS effective in protecting Tribal gaming assets and the interests of Tribal stakeholders and the gaming public. To that end, the following final rule revisions contain certain corrections and revisions to the Commission's existing MICS, which are necessary to clarify, improve, and update other existing MICS provisions. The purpose of these MICS revisions is to address apparent shortcomings in the MICS and various changes in Tribal gaming technology and methods. SUMMARY: This regulation sets forth the terms and conditions of the
2003/2004 American Indian Livestock Feed Program (AILFP). Assistance will be
available to eligible livestock producers for livestock feed crop years 2003
or 2004 whose eligible livestock occupied tribal-governed land at the time
of a natural disaster in an area where a significant loss of livestock feed
has occurred, creating a livestock feed emergency, as determined by the Commodity
Credit Corporation (CCC). Eligible producers can receive benefits for livestock
feed crop year 2003, or 2004, but not both. Eligible tribal-governed land must
be located in a primary county or counties that have received an emergency
declaration by the President or emergency designation by the Secretary of Agriculture
on or after January 1, 2003, for losses occurring in calendar year 2003, or
calendar year 2004. Although the Presidential declarations and Secretarial
designations were issued for natural disasters in those calendar years, tribal
governments may request an initial 90-day feeding period and up to three 90-day
extensions that extend from the beginning of a livestock feed crop year, to
the end of that same livestock feed crop year. Further, livestock owners who
sold eligible livestock as a direct result of natural disaster shall report
those livestock as owned through the end of the production year (livestock
feed crop year) in order to mitigate the livestock owner's losses. This rule

(ODEQ) and the Indian Nation Council of Governments (INCOG) into the Oklahoma
SIP and includes a demonstration of attainment for the 8-hour National Ambient
Air Quality Standard (NAAQS) for ozone. The MOA outlines pollution control
measures for the Tulsa Metropolitan Area Early Action Compact (EAC) area. The
EAC is designed to achieve and maintain the 8-hour ozone standard more expeditiously
than the EPA's 8-hour implementation rulemaking. EPA is proposing approval
of the photochemical modeling in support of the attainment demonstration of
the 8- hour ozone standard within the Tulsa EAC area and is proposing approval
of the associated control measures. We are proposing to approve this revision
as a strengthening of the SIP in accordance with the requirements of sections
110 and 116 of the Federal Clean Air Act (the Act), which will result in emission
reductions needed to help ensure attainment of the 8-hour NAAQS for ozone.

the resulting need for effective internal controls in Tribal gaming operations,
the National Indian Gaming Commission (Commission or NIGC) first developed
Minimum Internal Control Standards (MICS) for Indian gaming in 1999, and then
later revised them in 2002. The Commission recognized from the outset that
periodic technical adjustments and revisions would be necessary in order to
keep the MICS effective in protecting Tribal gaming assets and the interests
of Tribal stakeholders and the gaming public. To that end, the following final
rule revisions contain certain corrections and revisions to the Commission's
existing MICS, which are necessary to correct erroneous citations or references
in the MICS and to clarify, improve, and update other existing MICS provisions.
The purpose of these final MICS revisions is to address apparent shortcomings
in the MICS and various changes in Tribal gaming technology and methods. Public
comment to these final MICS revisions was received by the Commission for a
period of 48 days after the date of their publication in the Federal Register
as a proposed rule on December 1, 2004. Thereafter, the comment period was

trust estates to reflect an organizational change. The Department

by attorney decision makers in BIA and by administrative law judges
and Indian probate judges in OHA into a new Probate Hearings Division
within OHA. As a result, this rule transfers various regulatory provisions
dealing with attorney decision makers from BIA's regulations to OHA's.

to implement the proposed action identified in the Wanapa Energy
Center Final Environmental Impact Statement (DOE/EIS-0342, December
2004). Under the proposed action, Bonneville will offer contract
terms for interconnection of the Wanapa Energy Center with the Federal
Columbia River Transmission System, as requested by the Confederated
Tribes of the Umatilla Indian Reservation. The proposed project involves
constructing and operating a 1,200-megawatt, natural gas-fired, combined-cycle
power generation facility at a 47-acre site on tribal trust land
near the Cities of Hermiston and Umatilla in Umatilla County, Oregon.
Wanapa may construct this project in phases. A new switchyard will
be constructed at the Wanapa site, and Bonneville will construct
a new 500-kilovolt single-circuit transmission line from this switchyard
4.4 miles west to Bonneville's existing McNary Substation, which
Bonneville will expand by about 2.75 acres on the east side.

that recognizes the right of Indian self-determination and tribal
self-government. HUD negotiated the proposed rule with active tribal

SUMMARY: On December 15, 2004, the U.S. Fish and Wildlife
Service (Service or we) signed an annual funding agreement (AFA or
Agreement) with the Confederated Salish and Kootenai Tribal Governments
(CSKT) under the Tribal Self-Governance Act of 1994. The action was
taken at the discretion of the Service. The decision reflects review
and consideration of concerns, issues, and comments received during
a 90-day public comment period which began on July 14, 2004, and
ended on October 12, 2004. The public comment period was reopened
for an additional 15 days on October 20, 2004, and closed on November
4, 2004. The Agreement was re-negotiated and slightly re-worded following
the public comment period. The Agreement provides for the CSKT to
perform certain programs, services, functions, and activities (Activities)
for the National Bison Range and ancillary properties (Northwest
Montana Wetland Management District, Pablo, and Ninepipe NWRs) during
an 18-month period. The Regional Director for the Service in Denver,
Colorado, signed the agreement December 15, 2004. The Secretary of
the Interior immediately endorsed the Agreement, and forwarded it
to the U.S. Congress for a 90-day review period.

the Direct Implementation Tribal Cooperative Agreements (DITCAs)
Guidance on November 24, 2004. A copy appears below. The purpose
of this guidance is to describe the concept of DITCAs and their use
by EPA when performing direct implementation activities in Indian
country. EPA believes that the DITCA authority makes available an
important tool for tribes who wish to work with EPA in the implementation
of environmental programs in Indian country by allowing tribes to
be involved in assisting EPA as EPA implements federal programs for
tribes. DITCAs are intended to provide a method to accomplish program
implementation that is in addition to the Federal delegation of authority
method, also referred to as the "treatment in a manner similar
to states" or "TAS" approach to implementation. The
degree of tribal involvement in assisting with EPA's direct implementation
is flexible depending upon the tribe's interest and ability in carrying
out specific work.
