Notice of Intent To Prepare a Programmatic Environmental Assessment; Initiation of Public Scoping Under the National Environmental Policy Act; Initiation of Consultation Under Section 106 of the National Historic Preservation Act; and Notice of Intent To Develop a Section 106 Programmatic Agreement With the Alaska State Historic Preservation Officer

SUMMARY: EPA Region 10 intends to prepare a programmatic Environmental Assessment (EA) pursuant to the National Environmental Policy Act (NEPA), 42 U.S.C. 4321-4347, to evaluate the potential environmental and sociocultural effects of the EPA Contaminated Alaska Native Claims Settlement Act (ANCSA) Lands Assistance Program. The program provides funding to eligible Alaska Native Regional and Village Corporations, Federally Recognized Tribes in Alaska, Alaska Native Nonprofit Associations, Alaska Native Nonprofit Organizations and Alaskan Inter-Tribal Consortia (“applicants”) to investigate and remediate contamination present on ANCSA-conveyed lands at the time of conveyance. Through this notice, EPA is initiating scoping to help identify the scope of analysis, reasonable alternatives, and information sources, with particular attention to sociocultural issues tied to: (1) archaeological preservation and historic properties, including sacred sites and traditional cultural places; (2) protected subsistence resources and uses; and, (3) wetlands and associated aquatic resources. Concurrently, and pursuant to Section 106 of the National Historic Preservation Act (NHPA) (54 U.S.C. 306108) and its implementing regulations at 36 CFR part 800, EPA is initiating consultation with the Alaska State Historic Preservation Officer (SHPO), Federally Recognized Tribes in Alaska, Alaska Native corporations, and other consulting parties for the Contaminated ANCSA Lands Assistance Program. EPA intends to develop a Section 106 Programmatic Agreement (PA) under 36 CFR 800.14(b) with the Alaska SHPO and invited signatories and concurring parties to establish program-wide procedures for identifying, evaluating, and resolving effects to historic properties potentially affected by representative assessment and cleanup actions funded under the program. The EA will consider potential direct, indirect, and reasonably foreseeable impacts of representative cleanup actions funded under the program and will inform whether a Finding of No Significant Impact (FONSI) is appropriate or whether preparation of an Environmental Impact Statement (EIS) is warranted.

SUMMARY: This document announces that the U.S. Environmental Protection Agency (EPA), Region 9, made a final decision to issue, in accordance with the Clean Air Act (CAA), a Tribal Minor New Source Review (NSR) permit to Lupton Plant Property, LLC/Lupton Petroleum Products Inc. for the Lupton Facility under the CAA's Tribal Minor NSR Program. This permit authorizes the modification and operation of an existing transmix processing and bulk petroleum storage facility in Lupton, Arizona.

Minor changes are proposed. OCSE does not plan to renew either the Word version or the Excel 1115 Waiver version of the Tribal Budget and Narrative Justification Template.

Fraser River Panel Salmon Fisheries; Inseason Orders

SUMMARY: NMFS publishes inseason orders to regulate treaty tribal and non-tribal (all citizen) commercial salmon fisheries in United States (U.S.) waters of the Fraser River Panel (Panel) Area. In 2025, eight orders were issued by the Panel of the Pacific Salmon Commission (Commission) and approved and issued by NMFS for fisheries within the U.S. Panel Area. These orders established fishing dates, times, and areas for the gear types of U.S. treaty tribal and all citizen commercial fisheries during the period the Panel exercised jurisdiction over these fisheries.

Updating the Water Quality Certification Regulations

SUMMARY: The U.S. Environmental Protection Agency (EPA) is publishing this proposed rule to update and clarify several substantive and procedural requirements for water quality certification under Clean Water Act (CWA or the Act) section 401. CWA section 401 is a direct grant of authority to States (and Tribes that have been approved for “treatment as a State” status) to review for compliance with appropriate Federal, State, and Tribal water quality requirements any discharge into waters of the United States that may result from a proposed activity that requires a Federal license or permit. This proposed rule is intended to clarify several aspects of the certification process consistent with the statutory framework.

Approval of Clean Air Act General Permit Requests for Coverage for New Minor Source Gasoline Dispensing Facilities in Indian Country Within California

SUMMARY: On various dates, the U.S. Environmental Protection Agency (EPA) issued approvals to Glenn Quiroga of the Sycuan Tribal Development Corporation, Chairman Steven Estrada of the Santa Rosa Band of Cahuilla Indians, the Agua Caliente Tribal Corporation, the Soboba Economic Development Corporation, the Twenty-Nine Palms Band of Mission Indians Tribal EPA, the Twenty-Nine Palms Economic Development Corporation, the Agua Caliente Tribal Corporation, the Pala Band of Mission Indians, and the Table Mountain Rancheria (“Permittees”) under the Clean Air Act's Tribal Minor New Source Review (NSR) Program. The EPA approved these Requests for Coverage under the General Air Quality Permit for New or Modified Minor Source Gasoline Dispensing Facilities in Indian Country within California (“CA-GDF General Permit”) for Sycuan Market, Santa Rosa Pit Stop, LLC, the Agua Caliente Tribal Corporation Gasoline Dispensing Facility, the Soboba Economic Development Corporation Gasoline Dispensing Facility, Coachella Crossroads Travel Center, Cielo Travel Center, Agua Caliente Fuel Palm Springs, Agua Caliente Fuel Cathedral City, Joshua Tree 96 Travel Center, the Pala Super Mart, and the Table Mountain Rancheria Gasoline Station (“Sources”). These approvals authorized the construction of these Sources under the Tribal Minor NSR Program.
