340:75-19-18. Permanency planning for Indian children


Compliance with the Federal and State Indian Child Welfare Acts (ICWA) impact permanency planning for Indian children. Rules addressing permanency planning for children in DHS custody [OAC 340:75-6] are followed in providing services to Indian children and families.


(1) Placement preferences of the Federal ICWA are followed unless the state court finds good cause to alter the placement preferences.


(2) The child's tribe is included in permanency planning meetings, and encouraged to be active in the permanency planning process for the child.


(3) Active efforts are required in reunification efforts.
