Ordinance 2002-04 - Worker's Compensation Ordinance
| SUBJECT: | WORKER'S COMPENSATION ORDINANCE |
| WHEREAS: | The Elk Valley Rancheria Tribal Council is the governing body of the Elk Valley Rancheria/Tribe. |
| WHEREAS: | The Elk Valley Rancheria/Tribe has entered into a tribal-state gaming Compact with the State of California. |
| WHEREAS: | Section 10.3 of the Compact provides that the Tribe may create and maintain a system of redress work-related injuries. |
| WHEREAS: | The Elk Valley Rancheria/Tribe desires to enact an ordinance to redress work-related injuries |
| WHEREAS: | The Elk Valley Rancheria/Tribe is required to forward documents demonstrating a fully operational system to the State. |
| WHEREAS: | The Elk Valley Rancheria/Tribe is required to inform the State at least sixty (60) days prior to commencement of gaining under the compact of the Rancheria/tribe's election to create its own worker's compensation system or submit to the jurisdiction of the State and participate in the State Worker's Compensation Appeals Board system. |
NOW, THEREFORE, BE IT RESOLVED that the Elk Valley Rancheria/Tribe hereby adopts the following Worker's Compensation Ordinance;
BE IT FURTHER RESOLVED that the Worker's Compensation Ordinance shall be the exclusive means of redressing employee work-related injuries that occur at the Elk Valley tribe's gaming facility, Tribal Office and any other business owned or operated through the Elk Valley Rancheria/Tribe.
CERTIFICATION
I, the Chairman, hereby certify the foregoing resolution, which was
approved by the Elk Valley Rancheria Tribal Council on the 7th day of
August, 2002 was duly adopted by a vote of 7 AYES, 0 NOES, 0 ABSTAIN,
AND 1 ABSENCE and said ordinance has not been rescinded or amended in
any way. The Tribal Council is comprised of 9 members of which 7 voted.
