REDDING RANCHERIA VOLUNTARILY AGREES TO HONOR CHILD SUPPORT WAGE ASSIGNMENTS FROM THE DISTRICT ATTORNEY'S OFFICE

For the first time ever in the State of California, a Federally Recognized Indian Tribe has voluntarily agreed to honor wage assignments for child support from a District Attorney's Office.

Redding Rancheria Tribal Chairperson Tracy Edwards will sign a resolution recently adopted by the Tribal Council wherein the Council agreed to honor wage assignments for child support from the Shasta County District Attorney's Family Support Division. The resolution covers all employees of the Redding Rancheria and the tribe's subsidiaries and will go into effect January 1, 2002. In the past, the Tribe had informally honored the County's wage assignments but with its increased number of employees and emerging role as one of Shasta County's largest employers, the Tribal Council felt the responsibility to make a formal shift in policy.

While asserting the tribe's sovereign status, the Tribal Council's resolution states "it is in the best interests of the children whose parents owe state court-ordered child support to honor the County of Shasta's request for wage assignments from employees who work for the Redding Rancheria."

RESOLUTION NO. 063-11-06-01

A RESOLUTION OF THE TRIBAL COUNCIL OF THE REDDING RANCHERIA OF CALIFORNIA TO VOLUNTARILY WITHHOLD WAGE ASSIGNMENTS FOR THE COUNTY OF SHASTA FOR EMPLOYEES OWING CHILD SUPPORT

WHEREAS,	The Redding Rancheria of California ("Tribe") was restored and regained status as a Federally Recognized Indian Tribe, on December 22, 1983, rendered so by the Tillie Hardwick v. United States of America, No. C-79-1710-SW (N.D. Calif. Dec. 22, 1983) ;and
WHEREAS,	The Redding Rancheria of California is a federally recognized Indian Tribe and evidence of this is published in the Federal Registrar Vol. 62 Pg. 205; and
WHEREAS,	The Tribe is organized under a Constitution adopted on December 30, 1989, with the Redding Rancheria Tribal Council ("Tribal Council") as its governing body; and
WHEREAS,	The Tribal Council has jurisdiction over the businesses conducted on the reservation; and
WHEREAS,	The Tribal Council has the authority to adopt standards and policies for conducting business within the reservation boundaries and entering into government to government agreements; and
WHEREAS,	The Tribal Council places the utmost importance of taking care of the children of the future and the Elders; and
WHEREAS,	The Tribal Council believes that personal responsibility is part of an individuals daily life; and
WHEREAS,	The Tribal Council feels that the Redding Rancheria has authority to establish a Tribal Court to deal with matters such as child support and child custody, and has in fact asserted jurisdiction in Tribal children custody cases; and
WHEREAS,	The Tribal Council understands that the State of California thru the County of Shasta also has a system to deal with matters such as child support and child custody; and
WHEREAS,	The Tribal Council believes that it is important to have a cooperative working relationship with the District Attorney's office of Shasta County; and
WHEREAS,	The Tribal Council believes that the County cannot, in fact, assert its jurisdiction over the Tribe in such matters but finds that it is in the best interest of the children whose parents owe state court-ordered child support to honor the County of Shasta's request for wage assignments from employees who work for the Redding Rancheria; and

NOW, THEREFORE, BE IT RESOLVED, that the Redding Rancheria Tribal Council does hereby agree to honor the County of Shasta's requests for wage assignments for child support payments for employees who are employed by the Redding Rancheria and the tribe's subsidiaries.

NOW, THEREFORE, IT ALSO BE RESOLVED, that the Redding Rancheria Tribal Council will develop their own internal policy for collecting and submitting funds to the County of Shasta that are as similar as possible to the County's policies.

NOW, THEREFORE IT ALSO BE RESOLVED, that the Redding Rancheria Tribal Council reserves the right to collect a fee for the collection of funds that are to be submitted to the County of Shasta.

CERTIFICATION

The foregoing resolution was adopted at a duly convened meeting of the Redding Rancheria Tribal Council with a quorum present on this 6th day of November, 2001 with a vote of 4 for, 2 against, 0 abstentions.
