At the hearing on the order to seize the tribe shall have the burden of showing that there is a reasonable basis to believe that the property is subject to civil remedial forfeiture under the tribal ordinance alleged and that the property is within the jurisdiction of the tribal court. The tribe may present evidence by testimony or affidavit.
