13.01.100 Wavier of Sovereign Immunity

The Tribal Council may authorize officials representing any non-profit organization

chartered under this chapter to waive immunity on behalf of the non-profit organization only from suit attendant up to a contract or obligated amount but not over a stated contract amount and shall not attach to Tribal assets other than those designated to the non-profit organization. In instances where the Tribal Council authorizes an organization chartered under this chapter, a specific contract shall be extended to the organization by the Tribal Council under separate letter. In no instance shall the contract limit be extended without the express written consent and authorization of the Tribal Council.
