(a) If a review is conducted, the following factors shall be considered to determine whether the payer has the ability to pay during his or her period of incarceration: (1) Payer's assets and income during the period of incarceration, (2) Availability of employment during the period of incarceration, (3) Total length of incarceration, (4) Employability following incarceration, (5) Any other factors which the Tribal Court in each case determines are relevant.Lac Courte Oreilles Tribal Code of Law.
