Resolution No. 2024-23 — Resolution Adopting National Indian Gaming Commission Approved Gaming Code for the Lac Courte Oreilles Band of Lake Superior Chippewa Indians

WHEREAS, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians is a federally recognized Indian tribe ("Tribe") organized pursuant to the provisions of the Indian Reorganization Act of 1934, 25 U.S.C. §5101, et seq.; and,

WHEREAS, the Tribal Governing Board serves as the governing body of Lac Courte Oreilles Band of Lake Superior Chippewa Indians pursuant to Article III, § 1 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians; and

WHEREAS, the Tribal Governing Board is empowered pursuant to Article V, §1(m) and (n) of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians to "delegate to subordinate boards, officers, committees or cooperative associations which are open to all members of the Band any of the foregoing powers, reserving the right to review any action taken by virtue of such delegated powers" and "regulate, by enactment of ordinances, the conduct of business within the territory of the Band, including the power to impose taxes or license fees upon members and non-members doing business within the [R]eservation;" and

WHEREAS, the Tribal Governing Board enacted Resolution 95-63 and Resolution 2011-34 thereby approving the Lac Courte Oreilles Band of Lake Superior Chippewa Indians Amended Gaming Code; and

WHEREAS, the National Indian Gaming Commission ("NIGC") approved the Gaming Ordinance in accordance with the provisions of the Indian Gaming Regulatory Act; 25 U.S.C. §2701, et. seq. on September 19, 1995; and

WHEREAS, the NIGC approved the amendment of the Gaming Ordinance in accordance with the provisions of the Indian Gaming Regulatory Act: 25 U.S.C. §2701, et. seq. on August 11, 2011; and

WHEREAS, pursuant to the NIGC, the current and approved Gaming Ordinances are published on their website; and

WHEREAS, the Tribe hereby readopts and amends its current Gaming Code to reflect the NIGC's approved Gaming Code for the Tribe; and

WHEREAS, the Tribe has recodified the Lac Courte Oreilles Tribal Gaming Code as CMP.1 pursuant to Resolution 2022-68; and

WHEREAS, the Tribe shall readopt and amend the current Gaming Code to align with the NIGC and reformat the Gaming Code into the current Open Law format.

NOW THEREFORE BE IT RESOLVED, that the Tribal Governing Board hereby adopts and amends its current Gaming Code CMP.1 to be amended to the 1995 and 2011 approved versions by the NIGC in the Open Law format. The Tribal Governing Board, the Casino, and the Legal Department of the Tribe shall timely submit any amendments and edits of the Gaming Code to the NIGC for review and approval.

CERTIFICATION

I, the undersigned, as Secretary/Treasurer of the Lac Courte Oreilles Tribal Governing Board, hereby certify that the Tribal Governing Board is composed of seven (7) members, of whom 5 being present, constituted a quorum at a meeting thereof, duly called, convened, and held on this 12th day of February, 2024, that the foregoing Resolution was duly adopted at said meeting by an affirmative vote of 4 members, 0 against, 0 abstaining, and that said Resolution is a lawful act of the Tribe.
