Section ENV.03.12 — Recycling
(a) Materials identified as recyclable shall be separated from non-recyclable solid waste and recycled in accordance with the Stockbridge-Munsee Community Recycling Plan or other applicable materials.
(1) Recyclable materials are items that can be re-used, re-refined, reformed, smelted or serve as a raw material for manufacturing processes; these materials have a secondary market and collection facilities in place for such re-use.
(A) In general, recyclable materials include, but are not limited to, paper, cardboard, and containers made from glass, steel, aluminum, and plastics.
(B) Other materials, such as the following, are also recyclable, but need to be handled in a special manner: used engine oil, fluorescent light bulbs, old automobiles, wet cell batteries, major appliances, electronics, and tires.
(2) Non-recyclable solid wastes are those waste materials that are a part of the solid waste stream and do not currently have an available recycling process or are excluded from the recycling process for other reasons.
(b) No person may dispose of recyclable materials by abandonment, dumping, burning or using other destructive means on those materials.
(c) To the greatest extent practicable, recyclable materials shall be kept clean and free of contaminants such as dirt, oil, grease, food or non-recyclable materials.
(d) Yard waste and plant materials shall be disposed of through composting or burning in accordance with applicable laws. It shall not be included with solid waste that is disposed of in a landfill or other similar means.
(e) Responsibility for Recycling.
(1) Occupants of residential units shall be held responsible for recycling materials from their own household waste in accordance with this Ordinance.
(2) Owners of multi-family dwellings and non-residential properties shall have the final responsibility for recycling at their premises. However, owners shall not be held responsible for the actions of individuals on their premises, if they act to promote recycling at their premises as follows.
(A) Multi-family properties. Owners shall provide adequate, separate containers for recyclable materials and non-recyclable solid waste consistent with the following requirements.
(i) The number of recycling containers shall equal to or be greater than the number of solid waste containers; and
(ii) The owner shall ensure that one of the following requirements is met:
(I) The minimum total volume of recycling container space is equal to 20 gallons/week/dwelling unit; or
(II) The ratio of solid waste container volume to recycling container volume is at most 2:1; or
(III) An alternate method acceptable to the Environmental Program that does not result in the overflow of a recycling container during the time period between collection of materials and deliver to a recycling facility is used.
(B) Non-residential facilities.
(i) For the purposes of this section, this includes government or business facilities as well as multi-occupant residential facilities, such as a community-based residential facility, operated by Tribe or another organization on tribal land.
(ii) Owners shall provide adequate, separate containers for recyclable materials and non-recyclable solid waste consistent with the following requirements. The total volume of recycling containers shall be sufficient to avoid overflow during the time period between collection of materials and delivery to a recycling facility.
(C) Provide written notice to tenants, users and occupants of the premises about recycling requirements under this Ordinance, the Plan and any other recycling program at the premises.
(D) Provide for the proper collection and disposal of both recyclable and non-recyclable materials.
(E) Provide written notification to tenants, users and occupants of the premises about how to prepare materials and where to store the materials for collection.
