The Court shall determine, when necessary, whether an Elder is incapacitated and the degree of incapacity. A finding of incapacity shall be based on clear and convincing evidence of incapacitation and on a medical doctor's evaluation and report as to degree of incapacitation. A guardian may be appointed pursuant to YAE.03, Guardianship.Stockbridge-Munsee Tribal Code.
