Resolution No. 054-02 — Prevailing Wage

WHEREAS, The Stockbridge-Munsee Community, Band of Mohican Indians, is a federally recognized Indian tribe governed by the Stockbridge-Munsee Tribal Council pursuant to authority vested in the Council by a Constitution approved in November 1937; and,

WHEREAS, The Stockbridge-Munsee Community has the authority under its constitution and its inherent rights as a sovereign nation to adopt ordinances; and,

WHEREAS, The 2000 amendments to the Native Housing Assistance and Self-Determination Act of 1996, 25 U.S.C. 4114(b), "NHASDA" permits Indian Tribes to bypass Davis-Bacon wage requirements, so long as the Tribe has its own Prevailing Wage law, and the Tribe agrees to pay the Tribally established prevailing wage, for projects/grants/contracts funded through NHASDA; and,

WHEREAS, The Stockbridge-Munsee Community desires to adopt Chapter 55-A, the Stockbridge-Munsee Community Prevailing Wage Ordinance in order to effectuate the purposes of the 2000 amendments to the NHSDA.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts Chapter 55-A, the Stockbridge-Munsee Community Prevailing Wage Ordinance.
