Resolution No. 002-06 — Revenue Allocation Plan

WHEREAS, The Stockbridge-Munsee Community, Band of Mohican Indians, is a federally recognized Indian tribe with inherent sovereign powers, and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution; and,

WHEREAS, The Stockbridge-Munsee Community has the authority under its constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances; and,

WHEREAS, Class III gaming per capita payments are governed and regulated by Chapter 27, the Revenue Allocation Plan; and,

WHEREAS, Chapter 46, Housing currently contains a clause that allows for a landlord remedy that could allow for per capita payments to be attached for rent payments, which would contradict Chapter 27.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby amends Section 46.6-8(A)(5).
