Resolution No. 018-16 — Gaming

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers, and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribe is authorized to conduct gaming activities on the Stockbridge-Munsee Reservation in accordance with federal gaming law and its Gaming Compact with the State of Wisconsin;

WHEREAS, The Tribe regulates such gaming activities through Chapter 25, the Gaming Ordinance, which was approved by National Indian Gaming Commission as required under federal law;

WHEREAS, Revisions to Chapter 25 were identified that included changes to the definitions of ancillary facility, key employees and primary management officials, additional language for addressing disputes in relation to changes to operating procedures, additional bases for suspension or denial of a gaming license, among others contained in the attached version of the Revisions showing all additions and deletions;

WHEREAS, Such revisions were adopted by the Tribal Council in Resolution 02-16 and, on October 13, 2015, were submitted to the National Indian Gaming Commission for approval;

WHEREAS, The National Indian Gaming Commission identified additional changes to Chapter 25 that were required by federal regulation;

WHEREAS, On November 18, 2015, the Tribal Council submitted a letter withdrawing its October 13, 2015 request for approval of Chapter 25;

WHEREAS, The Tribe has made additional updates to Chapter 25 that include changes to the 2015 revisions as well as the changes required by federal regulation;

NOW THEREFORE BE IT RESOLVED, the Stockbridge-Munsee Tribal Council hereby adopts the following amendments to Chapter 25:

  • Renumbering of entire ordinance.
  • Addition of Table of Contents.
  • Changes or additions to Sections: 25.4(A), (I), (R), (S), (X), (Z) and (EE); 25.8(N); 25.9(H)(2)(b) and (e); 25.9(H)(3)(a) and (c); 25.9(K)(1); 25.9(L); 25.9(L)(1), (16), (20), (29), (30), (31)(d), (32)(a), (32)(a)(iv), (32)(c), 32(c)(i)-(iii) and (38); 25.9(M)(1)(b); 25.9(N); 25.9(O); 25.10(D)(1), (4), (4)(a)-(b); 25.10(E)(1)-(3); 25.10(F) and (F)(1), 25.10(G), (H), (J) and (K); 25.11(F), (F)(2) and (F)(5); 25.14(P); 25.15(B); 25.15(C)(2)(o) and (9); 25.15(D)(1) and (a)-(d); 25.15(E); 25.15(J)(6); 25.15(K) and (1)-(3); 25.15(L)(1)-(8); 25.15(N); 25.15(S); 25.16(C); 25.17(A), (A)(1)-(2), and (A)(7); and 25.21(A).
  • Deletion of Section: 25.15(R)(8).
  • Addition of new Sections: 25.4 (T) and (V); 25.7(G); 25.15(D)(2); and 25.15(J)(10).
  • Minor language clarifications in Sections: 25.1(D); 25.8(B), (G), (K) and (O); 25.9(D); 25.9(L)(3), (6), (11), (14), (19), (24), (25), (32)(1)(iii), and (33); 25.10; 25.12(A); 25.14(A), (D), (E)(2)(b), (F)(2), (G) and (O); 25.15(C)(4); 25.15(D)(3)-(4); 25.15(J); 25.15(P)(6); 25.17(A)(4); 25.17(B); and 25.21(C)(1).

BE IT FURTHER RESOLVED, the Stockbridge-Munsee Tribal Council directs that the amendments to Chapter 25 be forwarded to the National Indian Gaming Commission for approval pursuant to 25 U.S.C. § 2710(e).
