Resolution No. 014-19 — Revenue Allocation Plan

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, Chapter 27, the Revenue Allocation Plan Ordinance, establishes the system that the Tribe uses to allocate and distribute gaming revenues in compliance with federal law;

WHEREAS, The Tribal Council wishes to amend such ordinance to authorize that individual per capita distributions may be made at the end of October, instead of the end of November, as well as clarify language that beneficiary trusts for minors and incompetents are eligible for the IRS safe harbor, allow interests in per capita payments to secure tribal loans against bankruptcy, and make minor changes to clarify the document;

NOW THEREFORE BE IT RESOLVED, the Stockbridge-Munsee Tribal Council hereby adopts the amendments to Chapter 27, which make the following changes:
