Resolution No. 012-20 — Appellate Procedure

WHEREAS, The Stockbridge-Munsee Community is a federally-recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to its 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend ordinances, including an Appellate Procedure Ordinance for the Stockbridge-Munsee Court of Appeals;

WHEREAS, The Stockbridge-Munsee Court of Appeals has recommended that the Rules of Appellate Procedure that it adopted subject to its rulemaking authority under Section 1.12 of the Tribal Court Code be codified in an ordinance;

WHEREAS, Chapter 5-A is a new Appellate Procedure Ordinance that codifies such Rules;

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee hereby adopts a new Chapter 5-A, Appellate Procedure Ordinance, as part of Stockbridge-Munsee tribal law.
