Resolution No. 023-22 — Healing to Wellness Court
WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;
WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt ordinances;
WHEREAS, The Stockbridge-Munsee Community recognizes the negative impacts that substance abuse and addiction issues have on the community and wishes to provide additional ways to help individuals with these issues find a path back to being a healthy and productive member of the community;
WHEREAS, The establishment of a Healing to Wellness Court would provide an option for diversion of legal offenders with substance abuse and addiction issues away from the regular court system and toward a more holistic, healing approach that involves a treatment-oriented perspective;
WHEREAS, The Tribal Council wishes to establish a Healing to Wellness Court as part of the Stockbridge-Munsee Tribal Court system through the adoption of the Healing to Wellness Court Ordinance, Chapter TCT.06;
NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts Chapter TCT.06, Healing to Wellness Court Ordinance, and authorizes its submittal to the U.S. Bureau of Indian Affairs for approval.
CERTIFICATION
I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 6, constituting a quorum, were present at a meeting duly called, noticed, and held on the 18th day of January, 2022, that the foregoing resolution was duly adopted at such meeting by a vote of 5 for, 0 against, and 0 abstaining.
