Resolution No. 024-22 — Communicable Disease, Vaccination, and Quarantine

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribal Council has adopted the Communicable Disease, Vaccination, and Quarantine Ordinance, Chapter SAF.04 formerly numbered as Chapter 26A;

WHEREAS, The Tribe's experience with the COVID-19 pandemic has identified areas where modifications are appropriate in order to best serve the public health needs of the Tribe; and

WHEREAS, The proposed amendments to intended to more clearly define the Tribe's public health authority, which includes replacing references to the Health Director with references to the public health authority, better describe how the Tribe responds to public health emergencies, and effectively address enforcement authority in relation to ordinance violations.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts the following amendments to Chapter SAF.04:

  • Amending the following subsections in SAF.04: 01(a), 02(c), 03(a), 04(a-h), 04(g)(1)(C), 05(a), and 05(c).
  • Creating the following new subsections in SAF.04: 01(d), 02(d-e), and 03(b-c).
  • Modifying the section name for: SAF.04.03 and SAF.04.04.

BE IT FURTHER RESOLVED, the Tribal Council authorizes the amendments be submitted to the U.S. Bureau of Indian Affairs for approval.

CERTIFICATION

I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 6, constituting a quorum, were present at a meeting duly called, noticed, and held on the 18th day of January, 2022, that the foregoing resolution was duly adopted at such meeting by a vote of 5 for, 0 against, and 0 abstaining.
