Resolution No. 009-24 — Healing to Wellness Court

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt ordinances;

WHEREAS, The Stockbridge-Munsee Tribal Council has adopted a Healing to Wellness Court Ordinance as Chapter TCT.06 of the Tribal Code in order to provide additional mechanisms to help community members with substance abuse and addiction issues find a path back to being a healthy and productive member of the community;

WHEREAS, The Healing to Wellness Court is intended to help participants through assistance and accountability in a court setting that uses a more holistic, healing approach;

WHEREAS, In order to encourage open and honest discussion as part of the court process and recognizing the sensitivity of the topics that may be discussed as part of Healing to Wellness Court hearings or be in court records, the Tribe believes it is appropriate to make changes to the ordinance in order to provide for closed hearings and to clarify confidentiality provisions; and

WHEREAS, The Tribal Council therefore wishes to amend the Healing to Wellness Court Ordinance, Chapter TCT.06.

NOW THEREFORE BE IT RESOLVED, that the Tribal Council hereby adopts amendments to Chapter TCT.06, Healing to Wellness Court Ordinance, described more specifically as deleting the reference to open hearings under Section TCT.06.06(g), adding a new TCT.06.08(a), renumbering the subsections in TCT.06.08, and making other edits to TCT.06.08.

BE IT FURTHER RESOLVED, the Tribal Council authorizes he submittal of the amended ordinance to the U.S. Bureau of Indian Affairs for approval.

CERTIFICATION

I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 7, constituting a quorum, were present at a meeting duly called, noticed, and held on the 2nd day of January, 2024, that the foregoing resolution was duly adopted at such meeting by a vote of 7 for, 0 against, and 0 abstaining.
