Resolution No. 028-25

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribal Council has adopted a Forestry Ordinance, ENV.02, which was designated as Chapter 22 prior to the Tribe's re-organization and renumbering of its Code in 2021;

WHEREAS, Amendments to the Forestry Ordinance have been proposed that include: changing references to the Tribal Forester to Forest Manager; the removal of the Forestry Committee By-Laws from the text of the Ordinance to instead be a stand-alone document as well as clarifications of the advisory role of the Committee in relation the Council; language updates to clarify intent including for the term stumpage and for non-timber forest products; establishment of a 35-foot buffer around streams that are not trout streams; re-organization of standards regarding ginseng harvesting; clarification of the process used for domestic clearing permits; clarification on standards for denial or revocation of permits, contracts, or contract changes; and clarification of processing for approved loggers list, the timber sale bid policy, and tribal logger preference.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts substantive revisions to the Forestry Ordinance that include the following:

  • The creation of new subsections in ENV.02: 02(v) and (w); .05(a) and (b); .10(c); .11(c); .15(d)(1-5) and (e)(1); .17(a)(1), (b) and (c); .18(b)(3); .23(c)(2), (d), (e), (f)(2), (f)(2)(A) and (B).
  • The modification of sections in ENV.02: .02(h), (l), and (aa); .03; .04; .06(d); .07; .09; .10; .11; .12; .14; .15; .17; .19; .20; .21; .22; .23; and .26(f)(5).
  • The deletion of subsections in ENV.02: .05 (Articles I-V); .23(c)(2); .23(d)(2), (5) and (6).
  • Moving the content in ENV.02.09(b)(1-4) to ENV.02.14(b)(1-4).

BE IT FURTHER RESOLVED, the authorizes the submittal of the amended ordinance to the Bureau of Indian Affairs for approval.

I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 4, constituting a quorum, were present at a meeting duly called, noticed, and held on the 1st day of April, 2025, that the foregoing resolution was duly adopted at such meeting by a vote of 3 for, 0 against, and 0 abstaining.
