Resolution No. 055-25

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribal Council has adopted an ordinance establishing its Revenue Allocation Plan, GMG.02;

WHEREAS, The Tribe is required to have an approved Revenue Allocation Plan by federal law if it wants the ability to issue individual per capita payments to tribal members; and

WHEREAS, The Tribal Council wishes to amend its Revenue Allocation Plan in order to distinguish payments issued as general welfare payments from per capita payments; establish a sliding scale for allocation of net gaming revenues; remove the limitation that the amount allocated for per capita payments could not exceed the amount budgeted for investments; permitting the Tribal Council to authorize the allocation of a per capita payment to either all qualified tribal members or to an identified group of qualified tribal members, such as elders; and to permit tribal members to opt-out of receiving a per capita payment in favor of receiving a tax-exempt general welfare payment.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts amendments to the Revenue Allocation Plan, GMG.02, that include revisions to update language and re-organize materials to improve clarity as well as the following.

  • Amending Section GMG.02.01 to add new purpose language and a definition section.
  • Adding a new Section GMG.02.02(e) and amending .03(a), .04(a), and .05(a) to establish a sliding scale for allocations of net gaming revenues.
  • Amending Sections GMG.02.03(b) and .05(a)(1) to clarify funding allocations.
  • Amending Section GMG.02.07(a)(2) to delete the limitation that the amount allocated for per capita payments could not exceed the amount budgeted for investments;
  • Adding new language on general welfare assistance, including an opt-out of a per capita payment for a general welfare payment, to Sections GMG.02.01(f), .05(2)(B), .07(c), and .07(g).
  • Adding a new Section GMG.02.07(b) to permit per capita payments to be issued to either all qualified tribal members or an identified group of qualified tribal members.

BE IT FURTHER RESOLVED, the Tribal Council directs that the amended ordinance be submitted to the Bureau of Indian Affairs for approval.

I, the undersigned, as Secretary of the Stockbridge-Munsee Tribal Council, hereby certify that the Council is composed of 7 members, of whom 7, constituting a quorum, were present at a meeting duly called, noticed, and held on the 2nd day of September, 2025, that the foregoing resolution was duly adopted at such meeting by a vote of 7 for, 0 against, and 0 abstaining.
