25.1.9.050 Immediate Appearance Before a judge
Whenever any person is detained for any violation of the Traffic Safety Code of other Rule or Regulation relating to motor vehicles punishable as a violation, he shall be immediately taken before an available Tribal Judge who has jurisdiction of the violation when:
(a) He request immediate appearance;
(b) Charge with driving while under the influence of intoxicating liquor or narcotic drug;
(c) Charged with failure to stop in the event of an accident causing death, personal injuries or damage to property;
(d) Charged with reckless driving;
(e) The arresting officer has good cause to believe the person arrested has committed a felony; or
(f) Be refuses to give his written promise to appear in court or acknowledge receipt of warning notice.
