1.07.050 Arrest; Without a Warrant

A peace officer may, without a warrant, arrest an Indian person:

(a) For a Tribal offense committed or attempted in his presence;

(b) When he has reasonable cause for believing the Indian person arrested has committed any offense. He is justified in making the arrest though it afterwards is found that the offense had not been committed by the party arrested. When an Indian person is arrested without a warrant, the officer must inform him of his authority and the cause of the arrest, except when he is in the cause of the arrest, except when he is in the actual commission of a Tribal offense, or is pursued immediately after said commission.
