A defendant in a criminal action need not testify. He is presumed to be innocent until the contrary is proved. The effect of this presumption is only to place upon the Tribe the burden of proving him guilty beyond a reasonable doubt. The defendant's failure to testify on his own behalf shall in no way be construed against him nor commented upon by the prosecutor.Turtle Mountain Band of Chippewa Indians Tribal Code.
