The granting of a new trial places the parties in the same position as if no trial has been held; all testimony must be reproduced and the former verdict cannot be used or referred to either in the evidence or in argument. Prior testimony of the previous trial can be used in accordance with the applicable Rules of Evidence.Turtle Mountain Band of Chippewa Indians Tribal Code.
