2.08.080 Refusal to Admit Requested Facts or Documents; Expense of Proof Charged to Party Refusing

If a party serves a sworn denial to a request for admission of fact or genuineness of documents and the requesting party thereafter proves such fact or the genuineness of such document, the requesting party may apply to the Court for an order requiring the denying party to pay the reasonable expenses incurred in making such proof, including reasonable agents or attorney's fees. The Court shall grant such order unless it finds that there were good reasons for the denial or that the admissions sought were of no substantial importance.
