24.42.100 Security Interests Arising Under Chapter 24.02-24.08 or 24.09-24.13

A security interest arising under Section 24.05.010, Section 24.06.050, subsection (c) of Section 24.08.110, or subsection (e) of Section 24.13.080 is subject to Chapters 24.42 through 24.48. However, until the debtor obtains possession of the goods:

(a) The security interest is enforceable, even if subdivision (3) of subsection (b) of Section 24.43.030 has not been satisfied;

(b) Filing is not required to perfect the security interest;

(c) The rights of the secured party after default by the debtor are governed by section 24.02 – section 24.08 or 41-02.1; and section 24.09 – section 24.13

(d) The security interest has priority over a conflicting security interest created by the debtor.
