26.11.320 Tampering with Evidence

It shall be unlawful and a Class [4] offense, while believing that an official proceeding or investigation is pending or is about to be instituted, to:

(a) alter, destroy, conceal or remove any record, document, or object with the intent to impair its verity or availability in such proceeding or investigation; or

(b) make, present, or use any record, document, or object knowing it to be false with a purpose to mislead a public servant who is or may be engaged
