26.11.390 Resisting Lawful Arrest

Any person with intent to prevent a law enforcement officer from affecting an arrest shall be guilty of a Class [3] three offense when he/she:

flees from a law enforcement officer, after being told by an officer that he or she is under arrest;

(a) Or creates a substantial risk of bodily harm to the officer or any other person,

(b) or employs justifying substantial force to overcome the resistance is guilty of resisting arrest.

(c) if in the course of such resistance or assistance, a law enforcement official incurs any physical injury, the person or persons shall be charged under 26.11.360.
