3.03.150 Admissibility of Declarations of Pedigree; Witness Has No Personal Knowledge.

Evidence of a hearsay statement of a matter concerning a declarant's own birth, marriage, divorce, legitimacy, relationship by blood or marriage, race-ancestry or other similar fact of his family history, even though the witness had no means of acquiring personal knowledge of the matter declared:

(a) is admissible if the Court finds that the declarant is unavailable, and

(b) may be admitted to the Court in the exercise of its discretion even if the declarant is available.
