36.03.120 Physical Abuse Great Bodily Harm. Penalty –

(a) Any person who willfully inflicts bodily pain, harm, impairment physical injury pain, and/or unreasonable confinement which results in intentionally causes great bodily harm to an Elder is guilty of Physical Abuse Great Bodily Harm and may be punished according to this code.

(b) Penalty.

(1) A person convicted of Physical Abuse Great Bodily Harm shall be imprisoned for a term of not less than sixty (60) days, not to exceed three hundred sixty-five (365) days and shall be fined an amount not less than five hundred dollars ($500.00) not to exceed two thousand five hundred dollars ($2500.00). Complete Mandatory Requirements (1-4) in Section 36.04.040.

(2) Per the second offense of Physical Abuse Great Bodily Harm, the sentence shall double.

(3) Per the third offense of Physical Abuse Great Bodily Harm, the sentence shall triple.
