36.03.150 Physical Injury. Penalty -

(a) Any person who negligently or recklessly inflicts bodily pain, harm or impairment upon an Elder, is guilty of physical injury and may be punished according to this code.

(b) Penalty.

(1) Any person convicted of Physical Injury against an Elder shall be imprisoned for a term of not less than ten (10) days, not to exceed one hundred eighty (180) days and shall be fined an amount not less than two hundred dollars ($200.00) not to exceed five hundred dollars ($500.00). Complete Mandatory Requirements (1-4) in Section 36.04.040.

(2) Per the second offense of Physical Injury, the sentence shall double.

(3) Per the third offense of Physical Injury, the sentence shall triple.
