36.03.180 Secondary Neglect. Penalty –

(a) Any person who unintentionally fails as a guardian who is legally and/or voluntarily responsible for an Elder's welfare to provide food, shelter, clothing, or services necessary to maintain the physical and mental well-being of the Elder, as defined in this code, is guilty of Secondary Neglect and may be punished according to this code.

(b) Penalty.

(1) Any person convicted of Secondary Neglect shall be referred to the Elder Protection Team to complete any recommendations and follow up with any referrals the team deems necessary.
