37.01.020 Authority of the Tribe to Regulate Domestic Violence Within Its Jurisdictional Territory

(a) By treaty, the Tribe has the right to exclude non-members as well as an inherent authority to protect its political integrity and provide for the welfare of its members and others who choose to live within its territory.

(b) Domestic violence on the Turtle Mountain Indian

Reservation seriously impacts the ability of the Tribe to provide for the health and well-being of its Tribal members and threatens the political integrity of the Tribe.

(c) The Turtle Mountain Band of Chippewa Indians shall exercise jurisdiction over all persons and all aspects of domestic violence on the Turtle Mountain Indian Reservation. However, the criminal provisions of this ordinance shall not apply to non-Indians.
