4.01.060 Stay of Execution; Posting of Bond

(a) The judge of the Tribal Court may grant a stay of execution of any final judgment, order, or writ of the Tribal Court pending an appeal, provided the appellant posts a bond with the clerk of the Tribal Court. The amount of the bond shall be set by the judge of the Tribal Court, but in no case shall it exceed:

(1) In a criminal case the amount of the fine including costs;

(2) In a civil case the equivalent to the amount of the judgment, including costs, or the value of the property, including costs, if the judgment is for the return of the property. The clerk of the Tribal Court, in lieu of bond, may provide for the safe keeping of the property or accept the surrender of other property as collateral as long as such property is of comparable worth.

(b) The clerk of the Tribal Court must notify within five (5) days of the posting of the bond, the other party by registered letter of the stay of execution pending appeal.
