40.12.090 Permit Denial

The Tribal Council may deny the permit or may impose permit conditions that will adequately protect against unreasonable degradation of the environment, public health, welfare and natural resources of the Reservation, if the Solid Waste Management Team determines that:

(a) The proposed method or location of collection, transportation, or the place or manner in which the solid waste is to be stored, processed, transferred, treated or disposed of will potentially be detrimental to, damage or pollute the environment, public health, welfare or natural resources of the Reservation; or

(b) The applicant has an incidence or history of failing to comply with this Act, similar federal or state regulations or is reasonably deemed not likely to comply with Tribal permit conditions.
