40.12.140 The Notice of Public Hearing

The Solid Waste Director shall publish a public notice of a public hearing on a permit application. The notice shall be the form approved by the Tribal Council, as specified in the Turtle Mountain Band of Chippewa Administrative Procedures Act, as amended Title 22 of the Turtle Mountain Tribal Act. The Tribal Council shall hold the hearing no earlier than twenty (20) days and no later than forty-five (45) days from applicant's receipt of the Statement of Issues. All written notices, requests, and statements shall be delivered personally or by certified or registered mail, return receipt requested.
