51.01.010 Findings

(a) The Turtle Mountain Tribal Council hereby finds and declares that:

(1) Hemp is a valuable agricultural crop

(2) This title will protect the health, safety, and welfare of the Tribe by becoming the primary regulatory authority over the production and processing of hemp within the Tribe's jurisdiction;

(3) The adoption of this title is in the Tribe's best interest; and

(4) The Agriculture Improvement Act of 2018 (commonly known as the 2018 Farm Bill) allows for the growth and processing of hemp, subject to regulations, so long as the hemp has a THC concentration of less than the acceptable hemp THC level; and

(5) The Tribe has sufficient resources and personnel to carry out the practices and procedures described in this title.
