9.01.020 Separate Property; Definitions, Rights, and Privileges

(a) All property, real and personal, of either spouse, owned or claimed by him, her, or they before marriage, and that acquired afterwards by gift, devise or descent, and also the increase, rents, issues and profits thereof, is the separate property of that spouse.

(b) Neither spouse has any interest in the separate property of the other except that neither can be excluded from the other's dwelling.

(c) Either spouse may, without the consent of the other, convey his, her, or their separate property.

(d) Either spouse may make a complete inventory of his or her separate property and file a signed and acknowledged copy with the Clerk of the Tribal Court. The filing of inventory is notice and prima facie evidence of the ownership of the property.
