Upon return of the warrant, or upon return of the summons showing service on the defendant, a Tribal Judge having power to commit shall proceed to examine the complainant and any other witnesses and receive any other evidence that may be produced touching the charge. The defendant shall have the right to be present at the examination and refute such charge, if he so desires.
