APPORTIONMENT ORDINANCE

POLICY FOR TE-MOAK COUNCIL APPORTIONMENT: NUMBER OF COUNCIL MEMBERS
The policy for apportionment of the Tribal Council is declared to be :
a) to provide the members of the Te-Moak Tribal Council who shall represent substantially equal numbers of enrolled Tribal members, in compliance with the Constitution of the Te-Moak Tribe of Western Shoshone Indians of Nevada.
b) to preserve the unity of the Te-Moak Tribe of Western Shoshone Indians of Nevada, as basis for selecting representatives in order to afford rational representation to Tribal Band groups in recognition of their governmental responsibilities and in recognition of their separate interest in local legislation.
APPORTIONMENT OF TRIBAL COUNCIL ACCORDING TO MEMBERSHIP POPULATION
a) Te-Moak Western Shoshone Council representatives shall be apportioned to each Colony and Reservation within the lots fixed by the Te-Moak tribe's Constitution to carry out the policy of representation according to population and still maintain the principle of one (1) person, one (1) vote.
b) Population of at lest fifty (50) enrolled Tribal members and not more than ninety-nine (99) members shall have one (1) representative seated.
c) Population of at least one hundred (100) enrolled Tribal members and not more than one hundred and ninety-nine (199) members shall have two (2) representatives seated.
d) Population of at least two hundred (200) enrolled Tribal members and not more than two hundred and ninety-nine (299) members shall have three (3) representatives seated.
e) Population of at least three hundred (300) enrolled Tribal members and not more than three hundred and ninety-nine (399) members shall have four (4 ) representatives seated.
CERTIFICATION OF ENROLLED TRIBAL MEMBERS:
It shall be the duty of the Te-Moak Tribal Enrollment Office to provide each Colony/Reservation of the total enrolled membership roll on the month of July of each year.
PRESENT TE-MOAK SHOSHONE COUNCIL MEMBERS:
a) The present Te-Moak Western Shoshone Council members shall serve their remaining term as per Tribal Election of October, 1982.
b) Wells Indian Colony shall have one (1) representative seated upon the enactment of this Apportionment ordinance who shall serve the remaining term.
CERTIFICATION
I, the
undersigned, as Chairperson of the Tribal Council of the Te-Moak Tribe
of Western Shoshone Indians of Nevada do hereby certify that the Te-Moak
Western Shoshone Council is composed of eight (8) members, of whom 7
constituting a quorum were present at a duly held meeting on the 1st
day of April 1983, and that the foregoing ordinance was duly
adopted at such meeting by an affirmative vote of 4 FOR, 2
AGAINST, 0 ABSTENTIONS, pursuant to the authority contained under
Article 4 , Section 3 (n) of the Constitution of the Te-Moak Tribe of
Western Shoshone Indians of Nevada, and that said ordinance has not
been rescinded nor amended in any form.

APPORTIONMENT ORDINANCE OF THE GOVERNING BODY OF THE TE-MOAK TRIBE OF WESTERN SHOSHONE INDIANS
[ORDINANCE NO.] 83-ORD-TM-O1
BE IT ENACTED BY THE TE-MOAK WESTERN SHOSHONE, THAT
This organization, which is an Indian Organization, as defined under the Indian Organization Act of June 18, 1934, as amended, known as the Te-Moak Western Shoshone Council, and we operate and function in accordance with our Tribal Constitution, as amended and approved August 26, 1982.
Article 4, Section 2 (b) authorizes the Te-Moak Western Shoshone Council apportionment of its Council members when a new Band is added pursuant to Article 3, Section 2; therefore, we, the Te-Moak Western Shoshone Council, came forth with this APPORTIONMENT ORDINANCE.
