TE-MOAK FENCE AND GATE ORDINANCE

Fences and Gate
1. Definitions
a. Fence shall mean a protection; an enclosing structure of any material intended to prevent intrusion from without, and straying from within.
b. Gate shall mean a protection; it is a contrivance for passing through a fence.
2. Closing Gates
Any Indian opening a gate upon the colonies or reservations or the exterior boundaries thereof, or any gate within Indian Country, shall close and secure the gate opened in the same manner as found by the Indian.
3. Destroying Gates/Fences
Tearing down, carrying away or destroying any gate or fence or part thereof within the jurisdiction of the Te-Moak Tribe.
4. Penalty
Every Indian who shall fail to comply with the provisions of Sections 2 and 3 shall be guilty of a violation and upon conviction may be sentenced to not more than five (5) days confinement, or fine not to exceed $120.00, or both.
CERTIFICATION
I, the undersigned, as Vice-Chairperson of the Tribal Council of the Te-Moak Tribe of Western Shoshone Indians of Nevada do hereby certify that the Te-Moak Western Shoshone Council is composed of 9 members of whom 8 constituting a quorum were present at a duly held meeting on the 9th day of September, 1983, and that the foregoing ordinance was duly adopted at such meeting by an affirmative vote of 6 FOR, 1 AGAINST, 0 ABSTENTIONS, pursuant to the authority contained under Article 4, Section 3 (n) of the Constitution of the Te-Moak Tribe of Western Shoshone Indians of Nevada, and that said ordinance has not been rescinded nor amended in any form.

ORDINANCE OF THE TE-MOAK TRIBE OF WESTERN SHOSHONE INDIANS OF NEVADA
[ORDINANCE NO.] 83-ORD-TM-O6
BE IT ENACTED BY THE TRIBAL COUNCIL OF THE TE-MOAK TRIBE OF WESTERN
SHOSHONE INDIANS OF NEVADA, AS FOLLOWS
That in accordance with Article 10, Section 2 of the constitution of the Te-Moak Tribe, approved May 3, 1938, as amended on August 26, 1982, as organized under the Indian reorganization Act of June 18, 1934, (48 Stat.), as amended by the Act of June 15, 1935, (49 stat. 378) that this Ordinance to be known as the "Te-Moak Fence and Gate Ordinance" shall be effective upon passage.
