Approved Ordinances for the Te-Moak Tribe of Western Shoshone

CHAPTER 4 - DISPOSAL AND LITTERING

7-4-1 Definitions

A) Te-Moak Tribal Council: For purposes in this ordinance the Te-Moak Tribal Council shall mean the Te-Moak Council.

B) Trash: Shall mean domestic waste material.

C) Related Disposals: Shall mean car bodies, animal carcasses, wire, metal items, trees and branches.

D) Outside Boundaries: Shall mean B.L.M. lands allotted to the South Fork Reservation and any lands that may be added to the Reservation in the future.

E) Dumpsite: Shall mean the South Fork Reservation Residental dumpsite, located in Section 7, Township 3 N Range 57 E. of the Mount Diablo Meridian.

F) Littering: Shall mean throwing refuse out of any vehicle or from horseback or scattering refuse of any kind.

 

C) Resident: A member who is physically residing within the exterior boundaries of the South Fork Reservation.


7-4-2 Technical Provisions:

A) The South Fork Band Council may consider the neighboring ranchers or other tribal members to dump and assess a fee or other suitable contributions or assignments of fees by South Fork Band Council Resolution.

B) The South Fork Council shall by Resolution segregate the dumping at the dumpsite. Places for car bodies, animals and waste shall be designated, the South Fork Band Council will be responsible for posting of signs at dumpsite.

C) This dumpsite shall be for the exclusive use of South Fork Reservation residents only except for provisions in Section 7-4-2, part A, of this Ordinance.

D) All Articles included in part 7-4-1 (B) (C) in this ordinance if dumped anywhere within the boundaries of the South Fork Reservation other than the designated South Fork Reservation Dumpsite shall be deemed unlawful to the extent that they are punishable by this ordinance.

E) No toxic chemicals shall be dumped at this site, such as cattle spray, plant pesticides and other destructive materials.


7-4-3 Penalties:

A) Any person that does not adhere to this ordinance shall be fined a sum of $25.00 for the first offense, any subsequent offense shall be fined $50.00 and or one (1) week community service or both.

B) Non-Tribal members shall be turned over to the State or Federal Jurisdiction empowered to enforce these provisions.

 


CERTIFICATION

I, the undersigned, of the Te-Moak Western Shoshone Council, do hereby certify, that the Te-Moak Western Shoshone Council is composed of 9 members, of who 8 consisting a quorum were present at a duly held meeting on the 3rd day of April, 1987, and that the foregoing Ordinance was duly enacted at such a meeting by the affirmative vote of 8 FOR, 0 AGAINST, 0, ABSTAIN, pursuant to the authority contained under Article 4, Section 3 (j) (n) of the Constitution of the Te-Moak Tribe of Western Shoshone Indians of Nevada.

ORDINANCE OF THE TE-MOAK TRIBE OF WESTERN SHOSHONE INDIANS OF NEVADA

[ORDINANCE NO.] 87-ORD-TM-O1


TITLE VII

THIS ORDINANCE UPON APPROVAL SHALL BE KNOWN AS THE SOUTH FORK RESIDENTIAL DISPOSAL AND LITTERING ORDINANCE.

BE IT ENACTED BY THE TRIBAL COUNCIL OF THE TE-MOAK TRIBE OF WESTERN SHOSHONE INDIANS OF NEVADA THAT:

This Ordinance is adopted to regulate dumping of trash or related disposals and littering on the South Fork Reservation and within all outside boundaries that are related to the South Fork Reservation and to have all waste segregated at the South Fork dumpsites. This ordinance shall be effective upon approval of the Te-Moak Council, pursuant to Article 4, Section 3 (n).
