Resolution No. 038-26

WHEREAS, The Stockbridge-Munsee Community is a federally recognized Indian tribe with inherent sovereign powers and is governed by the Stockbridge-Munsee Tribal Council pursuant to the 1937 Constitution, as amended;

WHEREAS, The Stockbridge-Munsee Community has the authority under its Constitution and its inherent rights as a sovereign nation to adopt and amend Ordinances;

WHEREAS, The Tribal Council has adopted the Solid Waste Management Ordinance, ENV.03, to address the management and disposal of solid waste on the reservation;

WHEREAS, The Tribe cooperates with the State of Wisconsin on waste disposal since solid waste and recyclable materials are transferred to facilities located with the State of Wisconsin;

WHEREAS, The State of Wisconsin has updated its laws regarding recycling requirements and the Tribe wishes to amend its ordinance to incorporate those changes, including updating the ordinance name to include recycling;

WHEREAS, The Tribe also intends to amend other portions of the ordinance to reflect current waste disposal practices, including that there is no solid waste disposal facility on tribal land, clarifying enforcement standards, and burn permit requirements.

NOW THEREFORE BE IT RESOLVED, that the Stockbridge-Munsee Tribal Council hereby adopts the following amendments to ENV.03:

Amend the following sections of ENV.03: .01(b); .02(a), (b), (c)(1) and (2), and (d); .03(a); .06(a); .07(b) and (b)(1) with renumbering; .09(a); .10(a), (b), (b)(1) and (b)(4) with renumbering; .12(a)(1)(A) and (B), (e)(2), (e)(2)(A), and .13(b)(1), (c), and (d).

Delete the following sections of ENV.03: .03(d) and (g) with renumbering; .05(c); and omit .11 entirely.

Add the following sections to ENV.03: .06(b); .07(b)(2); .10(b)(2), (b)(3), and (c); and .12(e)(2)(A) (i-ii), (e)(2)(B), and (e)(2)(B)(i-ii) with renumbering;

BE IT FURTHER RESOVED, the Stockbridge-Munsee Tribal Council renames ENV.03 as the Solid Waste Management and Recycling Ordinance.
