26.20.140 Disposing of Lighted Substances, Etc

(a) It shall be unlawful for any person to throw, drop, discard, or dispose of a lighted match, cigarette, cigar, ashes, fireworks, bottle rockets, smoke bombs, or other flaming or glowing substance or thing on or into any forest, brush, grassland or flammable vegetation from a vehicle, ATV, horse or otherwise, which may or does cause a wildfire.

(b) Anyone who violates this section commits a Class 1 offense. If a careless act results in a fire that spreads uncontrolled, it shall be a Class 2 offense. If any person intentionally, willfully, maliciously or recklessly starts a fire with any burning, glowing or flaming substance that causes a wildfire that destroys or damages any neighboring property or endangers firefighters, it shall be a Class 4 offense.
