40.18.230 Fees, Notices and Appeal

(a) The TM-TRP shall implement a fee system and schedule of fees, subject to the approval of the Tribal Council, which are applicable to the applicant for a Remediation Assessment Agreement, Remediation Agreement, Certificates of Completion or No Further Action letter authorized under this section. Fees shall cover all reasonable direct and indirect costs of the Tribal EPA Director's, the TM-TRP's and Compliance Officer's participation in any activity authorized by this section.

(b) The TM-TRP shall give written notice of the amount of the fee assessment to the applicant.

(c) The applicant for the Remediation Assessment Agreements, Remediation Agreements, Certificates of Completion and No Further Action letters authorized under this section may appeal the assessment to the Tribal Council within thirty (30) days of receipt of the notice.
