9.04.320 Jurisdiction

The Tribal Court has jurisdiction of an action brought under this section. The action may be joined with an action for divorce, annulment, separate maintenance, or support.

(a) A person who has sexual intercourse within the jurisdiction of the Turtle Mountain Reservation or within this state, thereby submits to the jurisdiction of the Tribal Court or the courts of this state as to an action brought under this section or the laws of this state with respect to a child who may have been conceived by that act of intercourse. In addition to any other method provided by resolution or Codal Section, personal jurisdiction may be acquired by personal service of summons within the boundaries of the Turtle Mountain reservation or within or without this state or by registered mail with proof of actual receipt.

(b) The action may be brought in the county in which the child or the alleged father resides or is found or, if the father is deceased, in which proceedings for probate of his estate have been or can be commenced.
