Section GMG.02.05 — Use Of Net Gaming Revenues: General Welfare Of The Stockbridge-Munsee Community And Its Tribal Members
(a) The Tribal Council hereby allocates a percentage that will be between 15% and 35% of Net Gaming Revenues in order to provide supplemental funding for tribal governmental general welfare programs and the general welfare of the Stockbridge-Munsee Community and its tribal members, including donations to charitable organizations. Such funding is to include new initiatives and to replace and/or supplement existing programs.
(1) Tribal governmental general welfare programs that are supplementarily funded by Net Gaming Revenues under this Section shall include, but shall not be limited to, the following tribal programs: housing, social services, health services and Stockbridge-Munsee Health and Wellness Center, Indian Child Welfare services, education, summer youth worker, food, and aging and disabled persons programs.
(2) If it deems it necessary, the Tribal Council shall have the authority to increase or decrease the percentage of Net Gaming Revenues allocated to funding the general welfare of the Stockbridge-Munsee Community and its tribal members. The percentage increase may be drawn from the percentage set by Section GMG.02.03 and Section GMG.02.04.
(A) If it deems necessary, the Tribal Council may allocate a percentage of the general welfare allocation to fund Per Capita Payments authorized under Section GMG.02.07 of this Plan.
(B) If it deems necessary, the Tribal Council may allocate a percentage of the general welfare allocation to fund assistance distributed in accordance with the with the Stockbridge-Munsee General Welfare Ordinance, Chapter ADM.04, including, but not limited to, tax exempt assistance provided to Qualified Tribal Members who opt out of a Per Capita Payment per Section GMG.02.07(c).
(C) Any revision of the allocated percentage herein shall be documented by a Tribal Council resolution, a copy of which shall be provided to the Secretary of the Interior.
(3) Any Net Gaming Revenues allocated to funding for general welfare that have not been expended as of the last date of this fiscal year may, at the Tribal Council's discretion after review of allocation performance, be allocated to the purposes set forth in either Section GMG.02.03, Section GMG.02.04, Section GMG.02.05, or Section GMG.02.07, or be allocated to funding for the general welfare for the subsequent fiscal year, or be allocated 50% into long-term investments and 50% into general welfare for the subsequent fiscal year.
